Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the services offered by Roam Recall, LLC (“Roam Recall,” “we,” “us,” or “our”), including our website at roamrecall.com, our progressive web application, our native iOS app, and related services (collectively, the “Service”).

By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

Roam Recall is a personal place memory product that helps you save, organize, and revisit places you have been or want to go — including features such as visit logging, lists, trips, maps, friend collaboration, visit tagging, optional Explore suggestions, read-only public list sharing when you choose to enable it, and optional Roam Recall Pro paid features.

We may add, change, or remove features at any time. We do not guarantee that any particular feature will remain available or operate without interruption.

2. Eligibility and accounts

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You are responsible for your account credentials and for all activity that occurs under your account. Notify us promptly at admin@roamrecall.com if you suspect unauthorized access.

You agree to provide accurate account information and keep it up to date. You may not create an account using false information or on behalf of someone else without permission.

3. Your content

“Your Content” means the information you submit to or store in the Service — including places, visits, ratings, notes, verdicts, tags, lists, trips, comments, and other materials you create or upload.

You retain ownership of Your Content. You are solely responsible for Your Content and for ensuring you have the rights needed to submit it, including when you tag friends, invite collaborators, or enable public list links.

To operate the Service, you grant Roam Recall, LLC a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, back up, reproduce, process, adapt, display, and distribute Your Content solely as necessary to provide, maintain, improve, secure, and promote the Service — including making content available to people you explicitly authorize through sharing features.

That license ends when Your Content is deleted from our active systems, except for reasonable backup retention, legal compliance, and dispute resolution as described in our Privacy Policy.

4. Sharing and collaboration

The Service is private by default. When you use sharing features, you control what others can see:

  • Visit tags send invitations that include relevant visit and place details to friends you select
  • Trip and list invitations grant collaborators access according to the role you assign (such as collaborator or viewer)
  • Public list links, when enabled by a list owner, allow anyone with the URL to view limited list information without signing in

You are responsible for reviewing sharing settings before you invite others or enable public links. We are not responsible for how recipients use information you choose to share.

5. Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, fraudulent, or abusive purposes
  • Harass, threaten, impersonate, or violate the rights of others
  • Upload content you do not have the right to share
  • Attempt to access another user's account or non-public data without authorization
  • Probe, scan, or test the vulnerability of the Service or circumvent access controls
  • Scrape, crawl, or harvest data from the Service except as permitted by us in writing
  • Interfere with or disrupt the Service, including through excessive automated requests
  • Reverse engineer or copy the Service except where applicable law expressly allows it
  • Use the Service to send spam or unsolicited communications

We may investigate violations and suspend or terminate access where we reasonably believe these Terms have been breached.

6. Third-party services and content

The Service integrates with third-party providers — including Clerk (authentication), Google (Maps Platform and place data), OpenAI (Explore suggestions), Stripe (web payments), Apple(In-App Purchase and subscription billing on iOS), and others for hosting, email delivery, and infrastructure. Your use of those features may also be subject to the third party's terms and policies.

Place information (such as names, addresses, hours, ratings, and business status) may come from third-party sources. We do not guarantee that third-party place data is complete, current, or accurate. You should verify important details independently before relying on them.

Links to external websites or mapping services are provided for convenience. We do not control and are not responsible for third-party sites or services.

7. Explore and automated suggestions

Explore generates place suggestions using automated systems, including OpenAI language models and Google Places search. When you use Explore, your prompt and optional location context are sent to these providers as described in our Privacy Policy. Suggestions are provided for informational purposes only. They may be incomplete, inaccurate, or unsuitable for your situation. You are responsible for evaluating suggestions before acting on them.

Explore usage is subject to monthly limits that vary by plan (Free and Pro). Cached results for identical prompts may not count against your limit. We may change limits or disable Explore at any time.

8. Plans, fees, and billing

Roam Recall offers a free plan with usage limits and an optional paid subscription, Roam Recall Pro (“Pro”), with higher limits and additional features. Current plan limits and Pro benefits are described in the app; we may change limits or features over time with notice where required by law.

Free plan

The free plan is available at no charge subject to usage limits — for example, caps on saved places, lists, trips, and monthly Explore searches. We may modify free-plan limits or availability at any time.

Roam Recall Pro

Pro is a recurring subscription billed monthly or annually at the prices shown at the time of purchase (currently US $2.99 per month or US $29.99 per year, before applicable taxes). Prices may change; if they do, we will provide notice as required by applicable law before charging you a new price.

Where you buy Pro — and how you manage it — depends on how you use the Service:

  • On the web, you complete payment through Stripe Checkout. You can switch between monthly and annual billing, update your payment method, view invoices, or cancel from the Stripe Customer Portal, accessible from your Account settings. Payment processing is provided by Stripe, and your use of Stripe Checkout and the Customer Portal is also subject to Stripe's terms and privacy policy.
  • In the iOS app, Pro is sold through Apple In-App Purchase. Payment is charged to your Apple Account and the subscription is managed by Apple. You can manage or cancel it in your Apple Account subscription settings (Settings → your name → Subscriptions); the app also links to Apple's manage-subscription screen and offers a “Restore Purchases” option. Purchases made through Apple are also subject to Apple's terms, and refunds for those purchases are handled by Apple, not by us.

Subscriptions automatically renew at the end of each billing period unless you cancel before renewal, through the applicable channel above. Cancellation takes effect at the end of your current paid billing period unless otherwise stated or required by law. After cancellation, you retain Pro access until the period ends, then your account reverts to the free plan. Content you created while on Pro remains subject to free-plan limits.

Except where required by law (or, for purchases made through Apple, as determined by Apple), fees are non-refundable and we do not provide prorated refunds for partial billing periods or unused subscription time. For a purchase made on the web, if you believe a charge is incorrect, contact us promptly at admin@roamrecall.com. For a purchase made through Apple, refund requests are handled by Apple.

Taxes may be added where required. You authorize us and our payment processors — Stripe for purchases made on the web, or Apple for purchases made in the iOS app — to charge your payment method for recurring subscription fees and applicable taxes.

Availability

The Service is provided on an “as available” basis. We do not guarantee uninterrupted or error-free operation.

9. Intellectual property

Roam Recall and its branding, design, software, and documentation (excluding Your Content) are owned by Roam Recall, LLC or its licensors and are protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding except as needed to use the Service in the ordinary course.

If you provide feedback or suggestions about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose without obligation to you.

10. Termination

You may stop using the Service at any time. You may delete individual content you control within the app, and you may permanently delete your entire account and associated data from your Account settings. Account deletion is irreversible. If you have an active Pro subscription purchased on the web, deleting your account automatically cancels it, effective immediately, and no further charges will be made; consistent with the billing terms above, we do not provide prorated refunds for the remaining period. If you purchased Pro through Apple In-App Purchase, that subscription is billed and controlled by Apple: deleting your Roam Recall account does not cancel it, and you must cancel it yourself in your Apple Account subscription settings to stop further charges. We may retain limited financial records (such as invoices and payment history) for up to five years where required for legal, tax, and accounting purposes. We may suspend or terminate your access immediately if we reasonably believe you violated these Terms, created risk or legal exposure for us or other users, or if we discontinue the Service. Where reasonable, we may provide notice, but we are not required to do so in every case.

Sections that by their nature should survive termination — including ownership, disclaimers, limitations of liability, and dispute provisions — will survive.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will meet your requirements, that data will be preserved without loss, or that place, map, or third-party information will be accurate or reliable.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROAM RECALL, LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Roam Recall, LLC and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to Your Content, your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

14. Disputes and governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your jurisdiction provide otherwise.

Before filing a formal claim, you agree to contact us at admin@roamrecall.com and attempt to resolve the dispute informally. We may modify this section in the future to include additional dispute-resolution procedures, including arbitration or class-action waivers, with notice as required by law.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms, except where applicable law requires otherwise.

16. General

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Roam Recall, LLC regarding the Service.
  • Severability. If any provision is unenforceable, the remaining provisions remain in effect.
  • No waiver. Failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our consent. We may assign these Terms as part of a merger, acquisition, or sale of assets.
